Go+ Membership - Terms of Service

 

These terms of service (“Terms”) are applicable to the Got2Go Inc., operating as Got2Go, (“Got2Go”, “we,” “our,” or “us”) Go+ Membership program. Please read the Terms carefully before you sign up for a Go+ Membership. By signing up for a Go+ Membership, you accept and agree to be bound and abide by these Terms, our General Terms of Service, Privacy Policy, Trust and Safety Guidelines, Event Ticket Exchange Policies, and all other policies posted on any Got2Go website and applicable to your use of the Got2Go Platform and/or Services, each incorporated herein by reference (collectively, the “Policies”), as a Got2Go registered individual user enrolled as a Go+ Member (a “Go+ Member”). Capitalized terms hereinafter used but not defined shall have the meaning given to them in the Policies. If at any point you do not agree to any portion of the then-current version of the Policies, do not sign up for a Go+ Membership or use the services or benefits that may be available to you as a Go+ Member.

1. Go+ Membership


Got2Go provides an online platform and marketplace that connects owners of residential or vacation properties to rent them on a short or long-term basis to renters seeking such Accommodation. Got2Go also acts as an intermediary of an online marketplace wherein ticket buyers and ticket sellers can both sell and purchase live event tickets (“Event Tickets”), which can be accessed here (the “Event Ticket Website”). The Go+ Membership program offers select benefits (as described below) to active Go+ Members (a “Go+ Membership”), which can be made available to you through an annual subscription plan (as further described below). Got2Go reserves the right, in its sole discretion, to alter or change the fees, services, membership structure and availability, or benefits available to Go+ Members through the Go+ Membership program.

Got2Go Guests or Travelers may use the Got2Go Platform without a paid Go+ Membership, however, the Go+ Membership Benefits outlined in these Terms are only available to active Go+ Members with an active Go+ Membership.

We reserve the right to accept or refuse Go+ Memberships at our sole discretion. Go+ Memberships have no cash or monetary value, and you may not transfer, assign or sell your Go+ Membership or any Go+ Membership Benefits.

Got2Go does not currently offer free trial period(s) for the Go+ Membership.

2. Go+ Membership Benefits


Go+ Members receive benefits associated with their Go+ Membership (“Go+ Membership Benefits”), as may be identified from time to time by Got2Go. Currently, Go+ Members will receive a discount (a “Go+ Member Discount”) on bookings and Event Ticket purchases made through the Got2Go Platform or Event Ticket Website, such that a Go+ Member shall pay a discounted rate, as calculated and shown to users of the Got2Go Platform prior to completing the booking or Event Ticket purchase. Go+ Membership Benefits may only be redeemed or available to the specific Go+ Member with an active Go+ Membership. For example purposes only, in order to receive the Go+ Membership Benefit on a booking through the Got2Go Platform, the same Go+ Member that completed the booking must be the Got2Go user that completes the check in for the same booking.

Go+ Membership Benefits are dependent on availability of Accommodations through the Got2Go Platform and/or Event Tickets through the Event Ticket Website, and are subject to change and may differ based on the specific location of an Accommodation or booking through the Got2Go Platform or event through the Event Ticket Website. We may also exclude some Accommodations and Event Tickets from receiving the Go+ Membership Benefits at our discretion. While a Go+ Membership is currently only available to individuals, Got2Go, in its sole discretion may extend Go+ Membership Benefits to companies or various organizations. Further, Got2Go reserves the right to offer family or group discounts and promotions at its sole discretion.

Go+ Membership Benefits are only available to Go+ Members through the Got2Go Platform, and may not be redeemed by a Go+ Member for bookings or accommodations arranged with a Host outside of the Got2Go Platform or for Event Tickets purchased outside of the Event Ticket Website. Go+ Membership Benefits may not be transferred, sold, shared, or assigned to any other Got2Go user. Got2Go may immediately and permanently cancel or terminate a Go+ Member’s Go+ Membership (without a refund owed or due) if Got2Go discovers that a Go+ Member is transferring, selling, or sharing Go+ Membership Benefits with any other user of Got2Go’s Services, including any discount codes provided by Got2Go to the Go+ Member.

Go+ Member who makes the booking must be the same individual who checks into the property of which said Member booked.

From time to time, Got2Go may choose in its sole discretion to add or remove Go+ Membership Benefits.

3. Go+ Membership Model and Pricing


The fees for the Go+ Membership are stated in the subscription or membership sign up process for a Go+ Membership (the “Go+ Membership Fee”). Any increase in the Go+ Membership Fee shall be communicated to you through your Got2Go Account or through the most recent email we have on record for your Got2Go Account with at least thirty (30) days prior notice before such change shall take effect.

You may purchase a Go+ Membership directly through the Got2Go Platform by navigating to the Go+ Membership page on our website and proceeding to create a Got2Go Account and becoming a Go+ Member or you may purchase a Go+ Membership directly when completing a booking through the Got2Go Platform and selecting the option to enroll in the Go+ Membership when it is made available to you. To sign up for a Go+ Membership, you must have at least one valid form of payment (debit or credit card) on file at all times. You may change your preferred payment method at any time. Go+ Memberships are an annual membership plan, wherein when you purchase a Go+ Membership, you agree to have your payment method charged on an annual, recurring basis, until terminated or canceled as stated within these Terms.

The Go+ Membership Fee will first be charged to your selected payment method on the date of purchase. If you complete the Go+ Membership purchase in combination with a booking through the Got2Go Platform, your payment method will be charged for the Go+ Membership Fee first to enroll you as Go+ Member (to avail you of the Go+ Membership Benefits) and then charge you for the booking separately. YOUR GO+ MEMBERSHIP WILL AUTOMATICALLY RENEW AT FULL PRICE ON THE ONE (1) YEAR ANNIVERSARY AND EACH SUBSEQUENT ANNUAL ANNIVERSARY OF THE DATE OF PURCHASE (EACH A “RENEWAL TERM”), AND THE THEN IN EFFECT GO+ MEMBERSHIP FEE PLUS APPLICABLE TAXES WILL BE AUTOMATICALLY CHARGED TO YOUR SELECTED PAYMENT METHOD ON A RECURRING BASIS (WITHOUT FURTHER NOTICE TO YOU, EXCEPT TO THE EXTENT THAT NOTICE IS REQUIRED BY APPLICABLE LAW). YOU MUST CANCEL PURSUANT TO THESE TERMS IF YOU DO NOT WISH FOR YOUR GO+ MEMBERSHIP TO AUTOMATICALLY RENEW.

From time to time, we may offer different terms and the fees for a Go+ Membership may vary, at our sole discretion. Temporary or permanent modifications are effective as soon as they are published and made available to a Go+ Member, and are applicable to all subsequent transactions. The Go+ Membership Fee is non-refundable except as expressly set forth in these Terms. Sales, excise or other similar taxes may apply to any Go+ Membership Fee.

4. Term


Unless otherwise provided herein, the term of this agreement shall commence on the date a Go+ Member purchases a Go+ Membership (as outlined above) and shall continue thereafter until the Go+ Membership is terminated or canceled. For an avoidance of doubt, these Terms shall remain in full force and affect while you are a Go+ Member.

5. Termination or Cancelation


We may terminate or suspend your Go+ Membership and/or access to the Got2Go Platform for any or no reason, including without limitation, any violation of these Terms or our General Terms of Service. We will not give any refund for termination related to conduct that we determine, at our discretion, violates these Terms or any applicable law, involves fraud or misuse of the Go+ Membership, or is harmful to our interests or those of a Got2Go user.

You may cancel your Go+ Membership at any time through your Got2Go Account, by emailing us at “support@got2go.com” or by calling Got2Go’s Customer Service at 844-I-GOT2GO (844-446-8246). There are no refunds for Go+ Membership fees paid, except as expressly provided in these Terms or in the sole discretion of Got2Go. If you cancel your Go+ Membership, you can continue to use your Go+ Membership until the end of your paid Go+ Membership term, and any Go+ Member Discount shall remain active for bookings or Event Tickets made while under an active Go+ Membership. In order to avoid charges for a Renewal Term, you must cancel your Go+ Membership (as stated above) no less than forty-eight (48) business hours before any Renewal Term. If you cancel with less than forty-eight (48) business hours, Got2Go cannot guarantee that you will not be automatically charged for a Renewal Term, however, please contact our Customer Support Team via email or phone to cancel your Go+ Membership. Without limiting the foregoing, if you cancel your Go+ Membership during an active membership and outside of the time frame set out above for canceling before a Renewal Term, you will not receive a refund.

Got2Go shall not be responsible for any overdraft fees that may be incurred. Got2Go shall correct any processing errors related to payments, however, if you are considering initiating a chargeback, you agree to first attempt to resolve directly any disputed transaction fees with us or our third party payment service provider. Should you file a chargeback or dispute on a Go+ Membership purchase you have made on the Got2Go Platform, we reserve the right to terminate or cancel your Go+ Membership without notice.

All provisions of the Terms shall survive termination or cancelation by either party.

6. Refunds


Got2Go shall not be responsible for a refund or credit of any fees, costs, expenses, and/or charges paid by the Go+ Member prior to the termination of the Go+ Membership (and subsequent Renewal Term) and enrollment as a Go+ Member. Under no circumstance shall Got2Go be obligated to offer a refund, even if the Go+ Member does not use their Go+ Membership or Go+ Membership Benefits.

7. Go+ Membership Conduct


All Go+ Members shall abide by Got2Go’s code of conduct and general expectations of all users of the Got2Go Platform as outlined in our general Terms of Service found here.

8. Privacy


Got2Go’s Privacy Policy can be found here. By signing up for a Go+ Membership, you agree that you expressly consent to the uses of your information as set forth in our Privacy Policy.

9. Changes to Go+ Member Terms of Service


We may revise and update these Terms from time to time in our sole discretion, including changes to the model, pricing, benefits, or any aspect of a Go+ Membership without notice of liability to you, where such changes are non-material. If we do so, we will post the revised Terms and update the “Last Updated” date at the bottom. We will post a notice on the Services to advise you of any significant and material changes to these Terms. All changes are effective immediately when we post them, and apply to all access to and use of the Go+ Membership thereafter. Your continued subscription and enrollment of the Go+ Membership following the posting of revised Terms means you accept and agree to the changes. If you do not agree to any changes, please cancel your Go+ Membership consistent with these Terms.

10. Disclaimer of Warranties


YOUR USE OF THE GO+ MEMBERSHIP PROGRAM AND ANY SERVICES OR ITEMS OBTAINED THROUGH IT ARE AT YOUR OWN RISK. THE GO+ MEMBERSHIP PROGRAM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER GOT2GO NOR ANY PERSON ASSOCIATED WITH GOT2GO MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE GO+ MEMBERSHIP PROGRAM. WITHOUT LIMITING THE FOREGOING, NEITHER GOT2GO NOR ANYONE ASSOCIATED WITH GOT2GO REPRESENTS OR WARRANTS THAT THE GO+ MEMBERSHIP PROGRAM, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE GO+ MEMBERSHIP PROGRAM WILL BE ACCURATE, RELIABLE, AVAILABLE, ERROR-FREE, OR UNINTERRUPTED, OR THAT THE GO+ MEMBERSHIP PROGRAM OR ANY SERVICES OR ITEMS OBTAINED THROUGH IT WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

GOT2GO HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

11. Limitation on Liability


IN NO EVENT WILL GOT2GO, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, A GO+ MEMBERSHIP, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS, OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

12. Interpretation of These Terms


All interpretations of these Terms shall be at Got2Go’s sole discretion and shall be binding upon Go+ Members.

13. Entire Agreement; Conflicts


These Terms and our Got2Go Policies constitute the sole and entire agreement between you and Got2Go with respect to your Go+ Membership and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Go+ Membership. Without limiting the forgoing, these Terms shall at all times control and govern your use of the Go+ Membership. Any statements, opinions, comments, promises, or the like communicated about the Go+ Membership in conflict with these written Terms (as may be updated from time to time) by any person or entity (including a Got2Go affiliate, employee, service provider, agent, officer, or director) shall be null and void as of when such is communicated. Got2Go is not responsible, or liable to you or any third party, for your reliance on any communication about a Go+ Membership in conflict with these Terms.

15. Force Majeure

Got2Go shall not be liable hereunder for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials.
