Terms for buyers and sellers of tickets on Got2Go
Please carefully read these Terms of Service ("Terms" or "Agreement") before using the services provided by Got2Go, Inc. ("Got2Go," "we," "us," or "our"). These Terms govern your access to and use of Got2Go’s online platform, available at got2go.com and through other websites and services made available by Got2Go (collectively, the "Platform" or "Service"). By using the Platform, you agree to comply with and be legally bound by these Terms. If you do not agree with these Terms, you must immediately stop using the Service.
1. Eligibility
1.1 Age Requirement: You must be at least 18 years old to use the Services. By accepting this Agreement, you represent that you are of legal age to form a binding contract and have the authority to accept these Terms on behalf of any organization you represent.
1.2 Compliance: By using the Services, you agree to comply with all applicable laws, rules, and regulations. If you are using the Services on behalf of an organization, you confirm that you have the authority to bind the organization to these Terms.
1.3 Global Terms of Service: By registering for and using Got2Go’s platform, you also agree to our Global Terms of Service, which can be found at https://got2go.com/terms. These Global Terms of Service apply to all transactions and interactions across Got2Go’s platforms, including the purchase and sale of tickets and other services.
2. Services Overview
2.1 Marketplace Platform: Got2Go provides an online marketplace where users ("Buyers" or "Attendees") can buy and sell event tickets, passes, and related goods/services. Got2Go acts as an intermediary to facilitate these transactions but does not own the tickets listed on the Platform.
2.2 Role of Got2Go: Got2Go is not a party to the transactions between Buyers and Sellers. We provide a platform for connecting Buyers and Sellers but do not guarantee the existence, quality, or legality of tickets, nor do we control or ensure the performance of any contract between parties.
2.3 Ticket Delivery and Liability: Responsibility for the delivery and quality of tickets lies with the Sellers or our inventory partners. Buyers assume all risks associated with ticket purchases.
2.4 Availability of the Platform: Got2Go does not guarantee uninterrupted availability of the Platform. The Platform may be temporarily unavailable due to maintenance or technical issues. Got2Go may also restrict access to certain features if necessary for security or system integrity.
3. Ticket Pricing, Availability, and Fees
3.1 Ticket Pricing and Seller Control: Ticket prices are set by Sellers and may vary based on demand, promotions, or other factors. Got2Go does not control ticket prices, availability, or seating arrangements. Ticket availability can change quickly, and tickets for popular events may sell out before your purchase is completed.
3.2 Price Adjustments: Sellers can adjust ticket prices at any time. Once you purchase a ticket, you may not be eligible for a refund or credit if the price changes before or after your purchase.
3.3 Transaction Fees: The price displayed for tickets includes transaction-based fees, such as service and processing fees. Got2Go and its partners determine these fees. Go+ members may be eligible for discounted prices. Payment vendors may also charge additional processing fees, which will be reflected in the total cost.
3.4 Errors in Pricing and Availability: In the event of a pricing error (due to human or technical error), Got2Go reserves the right to cancel the order and issue a full refund. If you purchase a ticket before its official on-sale date or at an incorrect price, we will contact you to confirm your order at the correct price and delivery date or offer a cancellation with a refund.
4. Packages and Upsells
4.1 Overview of Packages and Upsells
For certain events, Got2Go may offer additional items and bundles through Event Partners. These include:
- Packages: All-inclusive offers that combine a ticket with additional products or services, such as premium seating, accommodation, transportation, dining, Go+ memberships, or exclusive merchandise.
- Upsells: Additional products or services available for purchase separately from tickets, such as accommodation, parking, merchandise, or other event-related add-ons.
4.2 Liability for Packages and Upsells
The products and services included in Packages and Upsells are provided by the relevant Event Partner or Host. Got2Go is not responsible for the delivery, quality, or fulfillment of these items, unless directly provided by Got2Go. If you have any questions or concerns regarding a Package or Upsell, please contact Got2Go's support team at support@got2go.com.
5. Refunds and Canceled or Rescheduled Events
5.1 Notification of Cancellations or Reschedules
In the event of a cancellation or rescheduling, Got2Go will make reasonable efforts to notify you as soon as we receive the relevant information from the Event Partner or Seller. Notifications will be sent to the contact details associated with your Got2Go account. It is your responsibility to ensure these details are kept up-to-date. However, we cannot guarantee prior notice of any changes, and we recommend that you regularly check official event news and communications from the event organizers or venue.
5.2 Event Cancellations
If an event you’ve purchased tickets or packages for is fully canceled (and not rescheduled), your order will be canceled, and a full refund will be issued for the price of your tickets or packages. The Seller is responsible for returning funds to Got2Go, which will then facilitate the refund to the Buyer. If an event spans multiple days and only some days are canceled, you may be eligible for a partial refund corresponding to the canceled days.
5.3 Event Reschedules
If an event is rescheduled, your tickets or packages will remain valid for the new date unless otherwise communicated by the seller or event organizer. Alternatively, equivalent tickets or packages may be offered for the rescheduled event, subject to availability. If you are unable to attend the rescheduled event, the Seller may specify a deadline by which you must notify them to be eligible for a refund. Failure to notify the Seller within the specified timeframe will result in your order being considered confirmed for the new date, and no refund will be issued unless required by law.
5.4 Refund Process
Refunds will be processed using the original payment method, or otherwise specified by Got2Go. If you paid by gift card, you will receive a replacement gift card for the amount paid. Some fees may be ineligible for a refund, and refunds will only be processed once the Event Partner or Seller confirms the cancellation to Got2Go. Sellers retain the right to set their own refund and cancellation policies.
5.5 Refunds for Upsells or Packages
If an Upsell or Package is eligible for a refund due to a canceled or rescheduled event, Got2Go will issue a refund for the amount paid, unless the product has already been delivered. If part of a Package or Upsell has been fulfilled, a partial refund will be issued based on the undelivered components. For package deals, Got2Go will clearly display refund policies for both the event ticket and any related accommodations. Sellers and Hosts reserve the right to reject refund requests outside of the advertised policy. When no policy is displayed, assume the purchase will not be refundable.
5.6 Replacement Tickets
Before purchasing tickets, please carefully review the event details and seat selection. Got2Go does not offer exchanges or refunds for lost, stolen, damaged, or destroyed tickets, including those that do not arrive by electronic mail, unless we can verify the seat corresponding to the ticket at the venue or reasonably cancel and replace a general admission ticket. In such cases, you must notify the Seller in advance, and they will have the discretion to replace the ticket.
6. Event Postponements and Changes
6.1 Postponements
In the event of a postponement, Got2Go will work with Buyers and Sellers to address any concerns regarding the validity of tickets. Sellers are prohibited from reselling, altering, or invalidating tickets for postponed events. If the event is ultimately canceled, refunds will be issued in accordance with the relevant refund policy.
6.2 Other Event Changes
For other changes such as partial performances, venue shifts, lineup modifications, or schedule adjustments, no refunds will be provided. Got2Go and the seller assumes no responsibility for these types of changes, and you will not be eligible for a refund under such circumstances.
7. Account
7.1 Account Registration
To list, sell, or purchase tickets, or use any of Got2Go's platforms (including lodging and hosting services), you must create an account with Got2Go and accept the terms of this User Agreement. By registering, you agree that Got2Go's Global Terms of Service apply to all transactions across Got2Go platforms, whether related to ticket purchases or other services. You must be at least 18 years old and capable of entering into legally binding contracts as mentioned in section “1. Eligibility.”
7.2 Account Information and Payment Methods
When registering for an account, you must provide accurate and complete information, including your full name, address, phone number, email address, and a valid payment method (e.g., credit card, debit card). You agree to promptly update your account information if any details change. Got2Go may charge any payment method on file for amounts owed, including costs, fees, or losses resulting from violations of this Agreement or applicable Additional Policies.
7.3 Account Suspension
Got2Go reserves the right to suspend or terminate accounts with incomplete or inaccurate information, or if we suspect misuse or a violation of this Agreement.
7.4 Account Security and Responsibility
You are solely responsible for maintaining the confidentiality of your account information, including your username and password. You are also responsible for any activity under your account, whether or not authorized by you.
8. Ticket Delivery
8.1 Third-Party Platforms
Got2Go uses third-party platforms such as Ticketmaster for ticket sales and distribution. The delivery of tickets may be managed by these external platforms, which operate under their own systems, terms and timelines. Got2Go has no control over their platforms or the ticket transfer process and is not responsible for any delays caused by these third parties.
8.2 Delivery Timeframes
Tickets will generally be delivered within 24 business hours of your purchase, provided all necessary actions are completed on your end (e.g., email verification, accepting ticket transfers, etc.). Failure to promptly complete these steps may delay ticket delivery. Please check your email and relevant platform for updates, and complete any necessary actions to ensure timely delivery. Delays caused by third-party platforms are beyond Got2Go's control. For issues with ticket delivery, please contact the relevant platform's customer service directly. Sellers agree to complete the ticket delivery process (to the point of needing buyer interaction) within 24 hours after the original sale date, and for orders within 48 hours of the event, deliver with urgency as soon as possible prior to the event beginning.
9. Safety and Risk
9.1 Event Safety
Got2Go serves as a platform for purchasing and selling tickets but is not responsible for event safety. Safety protocols, including security measures, health checks, and crowd control, are determined by event organizers and venues. Got2Go cannot guarantee your safety at events. Some events may involve risks such as light displays that could trigger medical conditions (e.g., epilepsy), loud noises, or other sensory impacts. Attendees should assess their individual tolerance to these conditions before attending.
9.2 Age Restricted Events
Event organizers determine age restrictions for their events. Got2Go prohibits underage users from purchasing tickets or using the platform. If an underage individual is purchasing on behalf of an adult, the buyer assumes all responsibility and liability, and Got2Go is not liable for any issues arising from such transactions.
9.3 Liability
Got2Go is not liable for incidents, accidents, or injuries that occur during an event. Liability for accidents or damages lies with the event organizers. Attendees should review the terms and conditions set by event organizers, as these may include their own liability provisions. If necessary, attendees should seek legal advice or contact local authorities regarding any incidents.
9.4 Searches and Security
Attendees may be subject to security checks, searches, and venue-specific policies such as bag checks or item restrictions (e.g., cameras). These policies are enforced by event organizers and venue security, and Got2Go does not manage or enforce these rules. Attendees must comply with all event-specific guidelines.
9.5 Accidents and Emergencies
In the event of an accident or medical emergency during an event, Got2Go is not responsible for providing medical support. Responsibility for medical intervention lies with the event organizers and venue. Sellers are also not liable for accidents that occur at events for which they list tickets.
10. Abuse of Our Site and Services
By using Got2Go's Site and Services, you agree not to:
- Use others' contact information or personal data for purposes outside the scope of ticket transactions or solicit sales outside our platform.
- Engage in abusive behavior, violate venue or event rules, or breach any laws, third-party rights, or Got2Go’s policies.
- Post misleading, defamatory, or false content, or fail to fulfill your sale/purchase obligations.
- Use Got2Go’s trademarks, content, or software without permission, or attempt to reverse-engineer, modify, or distribute them.
- Use automated tools (e.g., robots, scrapers) to access Got2Go's Site without consent, or overload the platform’s infrastructure.
- Interfere with the functioning of the Site or bypass access restrictions.
- Commercialize or export Got2Go’s applications or tools in violation of relevant laws.
Got2Go may use automated systems to detect and prevent fraud, which could lead to cancellations or suspensions of transactions or accounts. If this happens in error, please contact Got2Go for possible reinstatement.
11. Buying Tickets
You are responsible for reviewing the complete listing carefully before committing to purchase tickets. By placing an order, you are entering into a binding agreement with the seller to buy the tickets. Additional terms provided by the seller may also apply. Payments are processed through Got2Go and distributed to the seller according to our User Agreement. All sales are final, and once the purchase is complete, orders cannot be changed or canceled unless agreed upon by the buyer, seller and Got2Go, and Got2Go has discretion on the final outcome.
12. Selling Tickets
12.1 Compliance with Laws and Terms
As a seller, you must comply with all applicable laws, regulations, this User Agreement, and event or venue Seller Policies when listing, selling, and delivering your tickets.
12.2 Setting and Modifying Sales Price
When listing a ticket, you must set a price ("Sales Price") at which you are willing to sell the ticket. You may adjust the Sales Price or remove your listing at any time before the ticket is sold.
12.3 Binding Sale and Delivery Obligations
By listing a ticket, you make a binding offer to sell it at the Sales Price to any buyer who purchases it through Got2Go's platform. Once a buyer completes the purchase, you are contractually obligated to deliver the exact ticket at the agreed price and within the specified delivery timeframe. It is your responsibility to monitor your inventory and ensure that your listings remain accurate. Sellers are prohibited from canceling orders at one price and reposting the same tickets at a higher price. Failure to fulfill orders may result in charges, as outlined in this User Agreement and the Seller Policies. If you list your ticket(s) on other platforms and they are sold, it is the responsibility of the seller to remove the listing from Got2Go immediately.
12.4 No Guarantee of Sale or Listing Placement
Got2Go does not guarantee that your tickets will sell or that your listing will appear on the Site within a specific time, in a particular order, or in search results. Got2Go is not liable for unsold tickets, even if caused by outages, maintenance, or listing delays.
13. Payments and Fund Disbursement
13.1 Payment Processing
Got2Go acts as a limited payment collection agent for Sellers, handling funds on their behalf. Payments made by Buyers to Got2Go are treated as if made directly to the Seller for the amounts owed to Sellers, and Sellers are obligated to provide the purchased tickets as agreed. Got2Go assumes no liability for Seller actions or omissions.
13.2 Payment Disbursement to Sellers
Got2Go may hold funds from ticket sales until five business days after the event has concluded. After this period, funds are released to the Seller unless Got2Go exercises its discretion to hold, void, or refund funds in cases of suspected fraud or disputed transactions. Trusted partners may receive expedited payouts at Got2Go’s discretion. Got2Go pays out Sellers via ACH (direct deposit) and funds are expected to arrive within 9 business days once released.
13.3 Buyer Payment Obligation
Buyers must pay the full order amount, including Service Fees and applicable taxes, immediately using an accepted payment method. The Buyer’s payment obligation is fulfilled once Got2Go successfully receives the payment in full.
14. International Use of Got2Go Services
14.1 Global Access and Restrictions
Got2Go’s Services are accessible to users worldwide, but all international buyers and sellers are treated as U.S. customers. Use of the platform is prohibited in countries or by individuals subject to U.S. sanctions.
14.2 Legal Compliance
Buyers and sellers are responsible for complying with all applicable laws regarding the sale, purchase, and shipment of tickets. Sellers wishing to avoid international visibility must remove their listings from the platform.
14.3 International Events
Tickets for events outside your local region (“International Events”) may be subject to additional policies specific to the event’s location. Buyers and sellers should review local laws and these policies carefully.
14.4 Currency and Fees
All transactions made on Got2Go’s platforms are to be listed in US dollars. Any conversions or payment processing fees associated with international transactions are the responsibility of the Buyer and Seller.
14.5 Translations
Got2Go may translate listings for the US market, but accuracy is not guaranteed.
15. User Content
15.1 Intellectual Rights
You retain ownership of any content you submit, including images, text, audio, or other materials ("User Content"). By submitting User Content, you grant Got2Go a worldwide, perpetual, royalty-free, transferable, and sublicensable right to use, reproduce, distribute, display, or create derivative works from it in any media now or in the future. You also agree that Got2Go may use your name or image in connection with your User Content, if desired. You represent that the content is yours, that it does not infringe on any third-party rights (including intellectual property, privacy, or publicity rights), and that it is not false, defamatory, or harmful. You agree to indemnify Got2Go against any claims arising from your User Content.
15.2 Prohibited Content and Conduct
You are prohibited from submitting or posting content that is illegal, stolen, obscene, harassing, threatening, defamatory, or violates the rights of others. This includes, but is not limited to, content that contains nudity, explicit material, or harmful behavior toward individuals or groups. Got2Go reserves the right to monitor, edit, or remove any User Content at its discretion and will take appropriate action against content that violates these terms. Content related to stolen property is strictly forbidden, and Got2Go supports law enforcement in the recovery and prosecution of stolen items listed on the Site.
16. Taxes
16.1 Seller Responsibility for Taxes
As a seller, you are responsible for determining if any taxes apply to your ticket sales and for collecting and remitting such taxes, unless Got2Go is legally required to calculate, collect, and remit sales tax on your behalf. (In which case, you are required to inform Got2Go prior to fulfilling these obligations). Any applicable taxes must be included in the ticket’s Sales Price. If needed for tax reporting purposes, you agree to provide your Social Security Number or other tax identification number, authorizing us to share this information with relevant tax authorities without additional notice. Service fees include any applicable sales, use, excise, value-added, service, or other indirect taxes.
16.2 Indemnity Regarding Tax Obligations
You acknowledge that Got2Go is not responsible for ensuring the accuracy or appropriateness of any tax payments made on your behalf, except where required by law to handle sales tax calculations, collection, and remittance. You agree to indemnify and hold Got2Go and its affiliates, officers, agents, and employees harmless from any liabilities, costs, interest, or expenses (including reasonable attorney fees) arising from:
- Claims or disputes involving local, regional, national, or international tax obligations, including amounts owed under any tax laws, regulations, or orders.
- Disputes related to Got2Go's tax status.
16.3 Tax Advice and Assistance
Got2Go does not provide tax advice. For questions about your tax obligations related to ticket sales, we recommend consulting with your local tax authorities or a qualified tax professional. If you have additional concerns or need assistance, please contact us at partners@got2go.com, and we will do our best to guide you or connect you with the appropriate resources.
17. Miscellaneous
17.1 Governing Law and Dispute Resolution
This Agreement will be governed, interpreted, and enforced under the laws of the State of Florida without regard to the conflicts of laws provisions thereof. Any disputes arising under or related to this Agreement will be resolved in the state or federal courts of Fort Lauderdale, Florida and both parties irrevocably consent to exclusive jurisdiction of such courts.
17.2 Severability
If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
17.3 Modification of Terms
Got2Go reserves the right to modify these terms and conditions at any time. When we make changes, we will update the "Last Updated" date at the top of this document. You are encouraged to review this Agreement periodically for any updates. Continued use of the platform after modifications constitute your acceptance of the new terms.
17.4 Entire Agreement
This Agreement, along with any other legal notices and agreements published by Got2Go on the platform, shall constitute the entire agreement between you and Got2Go concerning the use of the platform.
